Our residents have rights.
Human rights and complaint/dispute policy for the residents we serve.
Complaint & Dispute Policy
Every person we support has rights. Under Virginia Code § 37.2-400, our residents are guaranteed the following human rights:
- To be treated with dignity and respect
- To be told about their treatment
- To have a say in their treatment
- To speak with others in private
- To have their complaints resolved
- To express their preferences
- To ask questions and be told about their rights
- To get help with their rights
Rights in a home and community-based setting
Under federal regulation 42 CFR 441.301, our residents also have specific rights in a home and community-based setting. These include, but are not limited to, the right to:
- Choose when and where to go in the community
- Have privacy, dignity, and respect
- Say no without being hurt or forced to do something they don’t want to do
- Learn how to stay safe at home and in the community
- Decline any services they don’t want
- Have a job if they choose
- Know what is written and said about them
- Keep their own money, clothing, and personal belongings
How we handle concerns
We explain these rights to each resident in a way they can understand. We also make sure they know that if they ever feel they are being treated unfairly, are being denied any of their rights, or have any other concern, they should tell someone they trust — such as their support staff, program director, program nurse, parent, guardian, or case manager.
Every concern is taken seriously. Each complaint is documented, kept in the resident’s file, and includes:
- The name of the person making the complaint
- Their address and contact information
- The date and time of the incident
- Their relationship to the person or agency involved
- The name of the agency and/or people involved
- A description of the complaint or concern
For each complaint, the person making it chooses an authorized representative to be notified and to help make sure the complaint is resolved to their satisfaction.
To share a concern or complaint, call or text (804) 399-9709 or email archera@archsupportres.com.
